Might be interesting to see what comes of this. Filed a complaint with the bbb and plan on getting my lawyer involved. The skinny is my car was towed and they damaged it. The owner of Cougar Recovery Service told me to basically to fuck off. Now i understand its just a car and i know dings/dent happen. This is one of those im not gunna let the big guy push the little guy around

Sat night my car was towed for being parked in a back lot without a sticker (unmarked lot, by the garbage cans). I take the blame for that. When I tried calling the number to recover my car there was no response. Two day I tried non stop calling and leaving voicemails. I figured the sign that said "24 hour pickup" by appointment might be true. That in fact is false. Some people might say well maybe they were gone for the weekend. Again, that is false. They were towing all weekend.

So 3 days without a car. Finally after calling to see if my car was there someone answered. I paid my fine and walked to the car. If you haven't seen where they keep your car then you don't want to. You would think, hey its probably in a paved lot with chain and barbed wire fence. Wrong. They have a metal gate being closed by a single chain. Anyone that wants to can walk up and do anything to any one of the cars they want.

Naturally when you pick up a car they make you sign a release form. There is nothing you can do but sign. I drive a car for a living, its part of my job/life. I got in the car and drove off, stopping at the nearest gas station to inspect the car. I wasn't going for gas as proved my my 9$ gas bill. When looking at the roof of the car I noticed a mark. After further review I found out it wasn't a mark but rather a giant 4 inch scratch. I didn't even get the carwash I paid for, but rather drove to the closest auto body shop. These were the exact words from the estimator "Wow that's deep. Its also fresh. It must have happened within the past few days." I wondered what he meant by that and he explained that the dust (clear coat/paint) shavings were still on the scratch.

Now this Chevy is my baby. You all have parents that have sports cars. You all know if the slightest ding is present you know about it. Same with myself. I had just got done washing and waxing the car the week before and I think this is something anyone would have noticed.

I called up Cougar and got transferred to someone. I explained my situation to one of the men working. I said it looked like a mark created by the magnet lights they put on cars when they tow them. He said no, they don't do that. His next words were he used new tape so there is no way this would have scratched the car. There was some other bull fed to me then had the nerve to tell me he didn't put any tape on my car. Wait a second, before he just admitted to using new tape on the car. Hmmm.... In other words, I got a big ol f-you kid. Its plain as day something was placed on the roof. Both sides of the roof have the same mark as if tape was placed there then improperly removed.

Geeze, I feel for you man. My car looks exactly how you think a 23 year old car would if you bought it from a hill billy but I'm still as careful with it about getting scratches and what not as if the paint was new. I hope you get that taken care of. Did the body shop give you an estimate of how much the repair would be?

corrected, either take it to small claims court for the cheap or cough up the change or insurance comp for it.

The thing you learn about lawyers is a lawyer is a lot like the Great American Pharmceutical company. They never are in a big rush to resolve or cure anything. The longer they can drag something out = the more money they make off hourly suckers. And even should you win a case, sometimes a lawyer still sticks you with a bill of some sort.

Probably a hommie hook up. At any rate it probably would help if you had someone with you when you made the contact call, when they informed you about this "new tape" they used. A credible witness statement would be nice for you as I'm sure they'll have their people there along with their declarations. I've had to make a declaration when I would sit in on a phone call from a client trying to twist his statements on the Attorney.

Well not free. When i first signed with the company they have a whole list of odd benefits, this was one of them. Every month my co. take 2$ out of my paycheck for personal lawyer fees. I think of my medical the same way, 20$/mo is basically free medical.

Youre best bet is to take this to small claims court.

The best thing you can do right now is...

DOCUMENT EVERYTHING! Write everything that is going on down. When it was towed, when it was returned, when you called and left voicemail and everything. Write it all down and make sure its got a date attached.

If you do go to court you need to make sure every single fact correct. If you slip up in court they are going to think your lying. Also, try to do everything with a witness from this point forward.
